These Terms of Service ("Terms") govern your access to and use of the services provided by Host Server SRL ("Opterius", "we", "us", or "our") through opterius.com. By creating an account or using our services, you agree to be bound by these Terms.
Opterius provides web hosting control panel software ("Opterius Panel"), billing and client management software ("Opterius Commerce"), and related hosted services ("Opterius Cloud"). Collectively these are referred to as "the Service".
You must be at least 18 years old and capable of entering into a legally binding agreement to use the Service. By accepting these Terms, you represent that you meet these requirements.
If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account.
You must provide accurate and complete information when registering. You must notify us immediately at office@opterius.com if you suspect unauthorised access to your account.
We reserve the right to suspend or terminate accounts that are found to be in violation of these Terms.
Opterius Panel is available free of charge for accounts managing up to 5 hosting accounts. The free plan includes full feature access with no functional restrictions. No payment method is required for the free plan.
Paid plans are available for accounts exceeding the free plan limits or requiring additional capacity. Pricing is published at opterius.com/pricing.
Subscriptions are billed in advance on a monthly or annual cycle. Payments are processed by Stripe, Inc. By providing payment details, you authorise us to charge the applicable fees to your payment method.
All payments are non-refundable. We do not offer refunds, credits, or pro-rata reimbursements for unused portions of a subscription period. This policy exists because the full feature set is available on the free plan — paid plans unlock capacity, not features.
We may change our pricing with at least 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
If a payment fails, we will attempt to retry the charge. If the payment remains unsuccessful after 14 days, your account may be downgraded to the free plan or suspended.
Your use of the Service is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violations of the Acceptable Use Policy may result in immediate account suspension or termination without refund.
You retain ownership of all data, files, and content you store or host using the Service ("Your Content"). You grant us a limited licence to store and process Your Content solely to provide the Service.
You are solely responsible for Your Content and for ensuring it complies with applicable law and our Acceptable Use Policy.
All Opterius software, including the Panel, agent binary, billing platform, and cloud infrastructure, remains the exclusive property of Host Server SRL. You may not reverse-engineer, decompile, redistribute, or attempt to extract or modify the source code of any Opterius product.
We operate the Service with reasonable care and skill. However, we make no guarantee of uptime or continuous availability. The Service may be interrupted for maintenance, updates, or circumstances beyond our control. We are not liable for losses resulting from downtime or service interruptions.
To the maximum extent permitted by applicable law, Host Server SRL shall not be liable for:
Our total cumulative liability to you for any claims arising under these Terms shall not exceed the amount you paid to us in the 3 months preceding the claim.
You agree to indemnify and hold harmless Host Server SRL, its officers, employees, and agents from any claims, damages, or expenses (including legal fees) arising from your use of the Service, Your Content, or your violation of these Terms or applicable law.
You may cancel your account at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refund is issued for the remaining period.
We may suspend or terminate your account immediately if you violate these Terms or our Acceptable Use Policy, or if we are required to do so by law. We may also terminate accounts with 30 days' notice for any other reason.
Upon termination, your right to use the Service ceases. You remain responsible for all charges incurred up to the termination date.
These Terms are governed by the laws of Romania. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Romania.
If you are a consumer resident in the EU, you may also refer disputes to the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
